📄 TERMS OF SALE (CGV) – DIGITAL PHOTOGRAPHY FILES (FRANCE)

2. Scope
These Terms govern the sale of digital photographic files sold online by the Seller to consumers and professionals.
3. Products
The Seller sells: Digital photographs (JPEG / RAW) & Downloadable image files
No physical products are shipped.
4. Prices
Prices are displayed in euros (€), all taxes included unless stated otherwise.
The Seller may modify prices at any time, but products are billed at the price in force at the time of the order.
5. Orders
An order is considered final once:
payment is confirmed via Stripe & confirmation email is sent to the Buyer
The Seller reserves the right to refuse any order in case of fraud, unpaid transactions, or technical issues.
6. Payment
Payments are processed exclusively via credit/debit card through Stripe

Stripe may process limited payment data as an independent controller

The Seller never stores banking data.
7. Delivery
Digital files are delivered: via secure download link, email delivery, or customer account access
Delivery is usually immediate after payment but may be delayed in rare technical cases.
The Buyer is responsible for ensuring access to download files.
8. No Right of Withdrawal (Digital Content)
In accordance with Article L221-28 of the French Consumer Code,by placing the order, the Buyer:
expressly requests immediate delivery of the digital content before the end of the withdrawal period;
acknowledges that they lose their right of withdrawal once the download or access begins.
No refund shall be granted after delivery of the digital content, except where required under applicable law.
9. Intellectual Property
All photographs remain the exclusive property of the Seller.
Purchasing a file does NOT transfer copyright. - The Buyer receives a limited license of use only as defined below.
Any unauthorized use is strictly prohibited.
10. Liability
The Seller is not responsible for:
technical issues after download file corruption due to Buyer systems misuse of images
Liability is limited to the amount paid for the order.
11. Governing Law
French law applies.
Disputes shall first be resolved amicably. If unresolved, they fall under French courts jurisdiction.
🎨 PHOTOGRAPHY LICENSE
1. Ownership
All photographs are protected under: French Intellectual Property Code & International copyright law
The Seller retains full copyright.
2. License Granted
By purchasing a digital file, the Buyer receives a:
Non-exclusive license
Non-transferable license
Personal use license (default)
Unless otherwise stated in writing.
3. Allowed Uses (Personal License) The Buyer may:
post photos on their private instagram, strava, facebook accounts print for personal use & display in private spaces
use as personal wallpaper & share privately (non-commercial)
4. Prohibited Uses
Without written permission, the Buyer may NOT:
Use photos for commercial influencer (instagram, facebook, TikTok ) purpose.
resell the image, distribute publicly, upload to stock websites
Use in commercial advertising modify for commercial use or claim authorship
5. Commercial License possible (Optional Upgrade)
If purchased separately or granted:
Might give right to use in commercial projects marketing materials or editorial use
But must always be specified per image.
6. Copyright Notice

7. Enforcement
Any unauthorized use may result in:
legal action compensation claims or takedown requests (DMCA-style enforcement)
